1. Definition and object of the contract

1.1 This contract ("Contract") is a distance contract pursuant to art. 50 and ss. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract concerns the sale of movable property between an online store called Toyshouse, with registered office in Viale delle Costellazioni 78, Bibione (VE) - 30020 - Italy, and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Toyshouse of a purchase proposal issued by the Customer via the internet, on the website www.toyshouse.it (the "Site").

1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by Toyshouse and shown on the Site, will remain valid and effective until they are modified and / or integrated by Toyshouse. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.The latest updated version of the Terms of Service is the one available on the Site.

1.3 By visiting our Site and/or purchasing something from us, you engage in our “Contract” and agree to be bound by the following terms and conditions (“Terms of Service”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the Site.


2. Prices, photos and descriptions

2.1 All prices shown are VAT included (except where expressly indicated) and are net of transport costs. The products presented on the site may no longer be available or on sale when the customer accesses the site and the relative prices may be subject to updates.

2.2 Delivery costs are indicated on the Site.

2.3 The photos do not always depict the real product sold, but are demonstrative, you must always check the title and description. All data published in the advertisements are considered valid, except for errors and omissions of transcription, in the title, in the price, in the quantity, in the description or in the photo.

3. Method of purchase and payment

3.1 The Customer will receive a summary e-mail from the Site, with which he will be informed that his purchase proposal is being processed and will be deemed accepted, unless otherwise communicated by e-mail within the terms indicated on the Site.

3.2 The Customer will be allowed to choose the method of payment from any means of payment indicated from time to time as valid by Toyshouse on the Site (For more information please visit our page "Secure payment").

4. Delivery of products, complaints

4.1 Toyshouse delivers the products to the address indicated by the Customer.

4.2 Any complaint regarding the purchase of a product can be forwarded to the reference address in the contact information on the Site.

4.3 The Customer can optionally request to insure the package, if not requested, Toyshouse WON'T BE responsible for any damages deriving from the transport.

4.4 For all international shipments directed outside the European Community, the shipping costs indicated on the Site DO NOT include charges, customs clearance, duties, ancillary taxes and any other contribution that may be required in order to complete customs clearance operations. The aforementioned expenses will be advanced by DHL and must be paid by the end customer to DHL during the collection of the shipment. Toyshouse WON'T BE responsible for any packages stopped at customs or not collected by the Customer. For more detailed information on customs clearance and taxes, please contact the competent branch of your country.

5. Product availability

Toyshouse accepts customer orders within the limits of the quantities of the required products existing in the warehouse. Therefore, the acceptance by Toyshouse of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Toyshouse undertakes to promptly notify the Customer of any unforeseen out of stock due to excess demand or other causes.

6. Customer obligations

The customer declares and guarantees to be a consumer according to the provisions of art. 3 of the Consumer Code, to be 18 or older and that the data provided by the same for the execution of the Contract are correct and true.

The customer is responsible for all taxes applicable to the delivery of your order, including sales tax, value added tax, custom duties and excise duties.

7. Registration and account closure

7.1 Browsing the Site does not provide for the registration of an account by the Customer, while if the Customer wishes to make purchases it is necessary to register an account. The account is personal and cannot be shared with other people. The registered user also has the possibility to upload his own content on the Site.

7.2 If the Customer wishes to close the account registered on the Site, he can contact our Customer Service. The cancellation or suspension of the account is at the discretion of Toyshouse and is not subject to conditions.

7.3 Toyshouse does not assume responsibility for any own content uploaded by the user, as there is no moderation of such content.

8. Jurisdiction

The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract will be the responsibility of the Court in which the Customer has his residence or domicile, if located in Italy, or of the Court of Pordenone, if the Customer has his own residence or home abroad.

Furthermore, the consumer established in Europe can take advantage of the platform made available by the European Commission for the resolution of any dispute arising from the online contract stipulated on the site. 9. Limitation of liability

Toyshouse will not be liable to users in the following situations:

1) if any losses occur which are not a direct consequence of a violation of the Terms by Toyshouse

2) if there are any damages or losses deriving from interruptions or malfunctions of the Site due to force majeure or unexpected and unforeseeable events and, in any case, independent of the will and beyond the control of Toyshouse.

11. Scheduled closing November 2023

From 24th October 2023 until 5th November 2023 it will not be possible to fulfill orders arriving on Toyshouse.it due to a scheduled maintenance intervention on the website. It will be possible to order as usual without any interference, however orders will be queued and will be processed starting November 5th. If there are orders with extreme priority, please contact customer@toyshouse.it before completing the order in order to be able to agree in advance the order processing and delivery times. Even if the order provides for fast-express delivery, it will not be possible to process orders before the 5th November 2023, the day on which activities will resume normally.

Christmas holidays December 2023

Like every year, we remind you that with the approach of the Christmas holidays and the end of the year, delivery times could be extended. We cannot guarantee that deliveries will keep the same timing so, if you are planning to send or receive a parcel for Christmas 2022, we advise you to order well in advance.

Furthermore, from 20 December 2023 until 8 January 2024 it will not be possible to process orders arriving on Toyshouse.it. It will be possible to order as usual without any interference, however the orders will be queued and will be processed starting from January 9th.
